Diese Allgemeinen Geschäftsbedingungen gelten für Anfragen und Buchungen von Ferienwohnungen, die über diese Website angeboten werden. Mit dem Absenden einer Anfrage oder der Annahme einer Buchungsbestätigung erkennen Sie diese Bedingungen an.
1. Geltungsbereich
Diese Bedingungen gelten für das Vertragsverhältnis zwischen Ihnen (Gast) und Willem Van Leeuwen (Anbieter) hinsichtlich der auf dieser Website dargestellten Ferienwohnungen.
Sie gelten ergänzend zu individuellen Bedingungen in einer Buchungsbestätigung. Bei Widersprüchen gilt für den konkreten Aufenthalt die Buchungsbestätigung.
2. Unverbindliche Anfrage
Eine über die Website oder das Gästeportal übermittelte Anfrage ist unverbindlich. Sie begründet keinen Vertrag und reserviert die Wohnung nicht.
Verfügbarkeit, Preise und Konditionen werden individuell geprüft. Der Anbieter kann eine Anfrage ohne Angabe von Gründen ablehnen.
3. Bestätigung und Vertragsschluss
Ein verbindlicher Vertrag kommt erst zustande, wenn der Anbieter die Buchung schriftlich per E-Mail bestätigt.
Bis zur Bestätigung kann jede Partei ohne Verpflichtung zurücktreten. Die Bestätigungs-E-Mail enthält Wohnung, Reisedaten, Preis, Zahlungsbedingungen und etwaige Sonderkonditionen.
4. Preise und Zahlung
Preise werden vor der Bestätigung individuell mitgeteilt und in der Regel in Euro ausgewiesen.
Zahlungsbedingungen einschließlich etwaiger Anzahlung und Restzahlung ergeben sich aus der Bestätigungs-E-Mail. Örtliche Steuern oder Tourismusabgaben können anfallen und werden angegeben, soweit bekannt. Akzeptierte Zahlungsmethoden stehen in der Bestätigung.
5. Stornierung
Stornierungsbedingungen werden individuell vereinbart und vor der Buchungsbestätigung mitgeteilt.
Nach der Bestätigung gelten die in der Bestätigungs-E-Mail genannten Stornobedingungen. Wurden keine besonderen Stornobedingungen vereinbart, kann der Anbieter entstandene Aufwendungen und entgangenen Buchungsgewinn im gesetzlich zulässigen Umfang berechnen.
6. Haftung
Gäste müssen Wohnung, Einrichtung und Gemeinschaftsbereiche sorgfältig behandeln. Gäste haften für Schäden, die sie selbst oder Personen verursachen, für die sie verantwortlich sind.
Für Verlust oder Beschädigung persönlicher Gegenstände haftet der Anbieter nicht, soweit zwingendes Recht nichts anderes verlangt (z. B. bei Vorsatz oder grober Fahrlässigkeit).
Die Haftung für leichte Fahrlässigkeit ist im gesetzlich zulässigen Umfang beschränkt. Zwingende Haftung bleibt unberührt.
7. Hausregeln
Gäste müssen die vor oder bei Check-in mitgeteilten Hausregeln einhalten. Dazu können Regeln zu Belegung, Ruhezeiten, Rauchen, Haustieren, Müll, Parken und Gemeinschaftseinrichtungen gehören.
Schwerwiegende Verstöße können den Anbieter berechtigen, den Aufenthalt vorzeitig zu beenden, ohne Erstattung ungenutzter Nächte, soweit gesetzlich zulässig.
8. Anwendbares Recht
Es gilt das Recht Spaniens einschließlich der auf den Kanarischen Inseln geltenden Vorschriften, unbeschadet zwingender Verbraucherschutzvorschriften Ihres Wohnsitzlandes.
Soweit zwingendes Recht nichts anderes bestimmt, ist Erfüllungsort San Miguel de Abona, Teneriffa, Spanien.

These Terms and Conditions apply to inquiries and bookings of holiday apartments offered via this website. By submitting an inquiry or accepting a booking confirmation, you agree to these terms.
1. Scope
These terms apply to the contractual relationship between you (the Guest) and Willem Van Leeuwen (the Operator) regarding holiday apartments presented on this website.
They apply in addition to any individual terms stated in a booking confirmation. In case of conflict, the booking confirmation prevails for the specific stay.
2. Non-binding inquiry
An inquiry submitted through the website or guest portal is non-binding. It does not create a contract and does not reserve the apartment.
Availability, prices, and conditions are checked individually. The Operator may decline an inquiry without stating reasons.
3. Confirmation and contract
A binding booking is concluded only when the Operator confirms the booking in writing by email.
Until confirmation, either party may withdraw without obligation. The confirmation email sets out the apartment, travel dates, price, payment terms, and any special conditions.
4. Prices and payment
Prices are communicated individually before confirmation and are typically stated in euros.
Payment terms, including any deposit and final payment, are set out in the confirmation email. Local taxes or tourist fees may apply and will be indicated where known. Payment methods accepted are those stated in the confirmation.
5. Cancellation
Cancellation terms are agreed individually and communicated before booking confirmation.
After confirmation, the cancellation terms stated in the confirmation email apply. If no specific cancellation terms were agreed, the Operator may charge reasonable costs incurred and loss of booking opportunity to the extent permitted by applicable law.
6. Liability
Guests must treat the apartment, furnishings, and common areas with care. Guests are liable for damage caused by themselves or by persons for whom they are responsible.
The Operator is not liable for loss of or damage to personal belongings, except where mandatory law requires otherwise (for example in cases of intent or gross negligence).
Liability for slight negligence is limited to the extent permitted by applicable law. Nothing in these terms limits liability that cannot be limited under mandatory law.
7. House rules
Guests must comply with house rules communicated before or at check-in. These may include rules on occupancy, noise, smoking, pets, waste disposal, parking, and use of shared facilities.
Serious breaches may entitle the Operator to terminate the stay early without refund of unused nights, to the extent permitted by law.
8. Applicable law
These terms and any booking contract are governed by the laws of Spain, including the rules applicable in the Canary Islands, without prejudice to mandatory consumer protection rules of your country of residence that cannot be waived.
Unless mandatory law provides otherwise, the place of performance is San Miguel de Abona, Tenerife, Spain.
